These Terms and Conditions of Sale (hereinafter referred to as the "Terms" or "T&Cs") govern all sales concluded through the website timed-horlogerie.com, operated by:

These Terms and Conditions of Sale shall be governed by French law.
ARTICLE 1 – Purpose
These Terms and Conditions of Sale define the rights and obligations of TIMED S.A.S and its Customers in relation to the online sale of watchmaking spare parts, components, watch crystals, movements, dials, hands, crowns, gaskets, batteries, tools, supplies, consumables, accessories, and other products related to watchmaking.
Any order placed on the website constitutes full, unconditional, and irrevocable acceptance of these Terms and Conditions of Sale.
ARTICLE 2 – Technical Nature of the Products
A significant proportion of the products sold by TIMED S.A.S are technical, fragile, and precision products intended for qualified users, professionals, repairers, watchmakers, and experienced enthusiasts.
The Customer acknowledges that watchmaking spare parts may require:

accurate model identification;
-
calibre verification;
-
dimension verification;
-
compatibility verification;
-
the use of appropriate tools;
-
adequate technical expertise.
TIMED S.A.S does not guarantee the compatibility of any part with a particular watch, movement, or assembly where the Customer has not provided all necessary information prior to placing an order.
ARTICLE 3 – Products, Descriptions, and Photographs
Products are described as accurately as possible.
However, photographs, colours, dimensions, references, cross-references, compatibility information, product names, and technical specifications are provided for guidance only.
Minor differences may exist due to:

manufacturing batches;
-
suppliers;
-
technical tolerances;
-
display screens and devices;
-
production changes;
-
equivalent or compatible references.
The Customer must verify before ordering that the product precisely meets their requirements.
In case of doubt, the Customer is encouraged to contact TIMED S.A.S before confirming the order.
ARTICLE 4 – Availability, Stock, and Restocking
Products offered on the website may be:

in stock and available for immediate dispatch;
-
available from supplier stock;
-
being restocked;
-
available to order;
-
available for pre-order;
-
available following specific procurement.
Due to the specialized nature of watchmaking spare parts, certain products may require a procurement period before shipment.
The Customer expressly acknowledges and accepts that certain ordered products may require a period of up to twenty-one (21) business days before being stocked, prepared, or dispatched.
Where a product is not immediately available, the order shall be processed as a procurement order, supplier order, or pre-order, depending on the nature of the product.
In the event of permanent unavailability after an order has been placed, TIMED S.A.S shall offer the Customer:

a refund;
-
store credit;
-
an equivalent product;
-
or an alternative solution accepted by the Customer.
ARTICLE 5 – Pricing
All prices are displayed in Euros (€), inclusive of all applicable taxes, excluding shipping costs.
Shipping costs are indicated before final order confirmation.
Any customs duties, local taxes, import duties, or administrative fees applicable outside Metropolitan France shall remain the sole responsibility of the Customer.
TIMED S.A.S reserves the right to modify its prices at any time.
The applicable price shall be the price displayed at the time the order is confirmed.
ARTICLE 6 – Orders
An order becomes final upon successful validation of payment.
Before confirming an order, the Customer must verify:

product references;

dimensions;
-
quantities;
-
delivery address;
-
product selection;
-
compatibility with their intended use.
TIMED S.A.S reserves the right to refuse or cancel any order in the event of:

a previous dispute with the Customer;
-
suspected fraud;
-
payment default;
-
an obvious pricing error;
-
an abnormal or unusual order;
-
supplier unavailability;
-
inability to procure the product.
Records and data stored on the website shall constitute evidence of transactions.
ARTICLE 7 – Payment
Payment may be made using the payment methods offered on the website, including:

PayPal;

Shopify Payments;

bank transfer;
-
any other secure payment method available at the time of ordering.
All payments are processed through secure payment systems.
TIMED S.A.S does not store or retain any Customer banking or payment card information.
ARTICLE 8 – Shipping and Delivery
Orders are shipped from France or from logistics platforms, suppliers, or partners used by TIMED S.A.S.
Shipments may be carried out through, among others:

La Poste Tracked Letter Service;

UPS;
-
FedEx;
-
Swiss Post;
-
Royal Mail;
-
Deutsche Post;
-
or any other suitable carrier.
The choice of carrier remains at the discretion of TIMED S.A.S unless a specific shipping option is offered and selected by the Customer during checkout.
Preparation and dispatch times vary depending on product availability.
For products in stock, orders are generally prepared and dispatched as quickly as possible.
For products being restocked, available to order, available for pre-order, or requiring supplier procurement, the dispatch period may take up to twenty-one (21) business days.
Any transit times communicated are estimates only and depend on the carrier.
The total delivery period may therefore include:

the procurement period;
-
the order preparation period;
-
the dispatch period;
-
the carrier's transit time.
TIMED S.A.S shall not be held liable for delays attributable to:
-
shipping carriers;
-
customs authorities;
-
governmental or administrative authorities;
-
strikes or industrial actions;
-
adverse weather conditions;
-
supplier shortages;
-
incorrect delivery information provided by the Customer;
-
or any circumstance beyond its reasonable control.
The Customer is responsible for inspecting the parcel upon delivery.
If a parcel appears damaged, opened, repackaged, or otherwise irregular, the Customer must:

make specific reservations with the carrier upon delivery;
-
take photographs of the parcel and its contents;
-
notify TIMED S.A.S within forty-eight (48) hours by email at info@timed-horlogerie.com.
Failure to report the issue within this period may result in the rejection of any claim relating to transportation damage.
ARTICLE 9 – Transfer of Risk
The transfer of risk shall occur in accordance with the applicable provisions of French consumer law.
Where the Customer is a consumer, the risk of loss or damage passes when the Customer, or a third party designated by the Customer, takes physical possession of the goods.
Where the Customer is acting in a professional capacity, the risk transfers upon delivery of the parcel to the carrier.
ARTICLE 10 – Part Compatibility
The Customer is solely responsible for verifying:

product references;
-
dimensions;
-
calibres;
-
compatibility;
-
shapes and configurations;
-
thicknesses;
-
diameters;
-
tolerances;
-
technical specifications.
TIMED S.A.S shall not be held liable for:
-
incorrect diagnosis;
-
selection of an unsuitable part;
-
incompatibility issues;
-
installation errors;
-
incorrect movement identification;
-
inaccurate measurements;
-
misinterpretation of product references.
Any request for advice prior to placing an order must be submitted in writing.
ARTICLE 11 – Watch Crystals, Fragile Components, and Precision Parts
Watch crystals, hands, dials, movements, crowns, gaskets, tubes, precision components, and watchmaking spare parts are fragile and technical products.
These products may be adversely affected by:

opening of the packaging;
-
handling;
-
testing;
-
installation;
-
pressure;
-
scratches;
-
tool marks;
-
deformation;
-
dust contamination;
-
removal or loss of protective film;
-
improper storage.
Watch crystals are particularly sensitive to scratches, micro-chipping, stress, pressure, incorrect dimensions, and installation errors.
Any watch crystal that has been handled, tested, installed, scratched, unsealed, removed from its protective packaging, or shows any sign of handling may be refused for return.
The Customer must verify all dimensions and references before opening, installing, or handling the product.
ARTICLE 12 – Returns: General Principle
Any return request must be submitted in writing to Customer Service at:

Any unauthorized return, incomplete return, improperly packaged return, late return, or return that does not comply with these Terms and Conditions may be refused.
Return shipping costs shall be borne by the Customer unless the return results from an error attributable to TIMED S.A.S or from a defect confirmed following inspection.
The Customer is responsible for ensuring that returned products are packaged appropriately and securely.
Any product returned broken, scratched, incomplete, oxidized, damaged, or deteriorated during return transit may be refused.
ARTICLE 13 – Conditions for Acceptance of Returns
To be accepted, a returned product must be:

new;
-
complete;
-
unused;
-
uninstalled;
-
not handled beyond what is necessary for inspection;
-
free from tool marks;
-
free from scratches;
-
free from deformation;
-
free from oxidation;
-
returned in its original packaging;
-
accompanied by all protective materials, labels, bags, films, and accessories.
TIMED S.A.S reserves the right to inspect all returned products.
Any product that can no longer be resold as new may be subject to:

refusal of reimbursement;
-
a reduction in the refund amount;
-
return to the Customer at the Customer's expense;
-
or partial store credit, at the discretion of TIMED S.A.S where permitted by law.
ARTICLE 14 – Products Excluded from Return Following Opening, Handling, or Installation
For reasons relating to safety, traceability, fragility, technical precision, and the impossibility of resale as new, the following products cannot be returned if they have been opened, handled, tested, installed, unsealed, modified, or damaged:

movements;
-
dials;
-
hands;
-
crowns;
-
tubes;
-
gaskets;
-
batteries;
-
adjusted watch straps;
-
technical components;
-
spare parts;
-
consumables;
-
used tools;
-
electrical or electronic products;
-
special orders;
-
personalized products;
-
products specially procured at the Customer's request.
This exclusion does not affect the Customer's statutory rights where the product is affected by a proven defect existing at the time of delivery.
ARTICLE 15 – Made-to-Order, Pre-Order, and Special Procurement Products
Products identified or processed as:
-
made-to-order;
-
pre-order items;
-
restocking items;
-
supplier-order items;
-
special procurement items;
-
or products specifically ordered for the Customer,
may require a lead time of up to twenty-one (21) business days before dispatch.
Where a product has been specially procured for the Customer, it may be excluded from return if its nature, reference, intended use, or specific characteristics prevent normal resale.
Special orders, personalized products, configured products, cut-to-size products, products selected according to Customer specifications, or products procured exclusively for a Customer are neither returnable nor exchangeable, except where a proven defect exists or where otherwise required by law.
ARTICLE 16 – Consumer Right of Withdrawal
In accordance with Articles L221-18 and following of the French Consumer Code, consumer Customers have a statutory period of fourteen (14) calendar days from receipt of their order to exercise their right of withdrawal without providing any reason.

The product must then be returned in accordance with these Terms and Conditions.
Return shipping costs shall remain the responsibility of the Customer.
The Customer is responsible for any reduction in value resulting from handling beyond what is necessary to establish the nature, characteristics, and proper functioning of the product.
ARTICLE 17 – Exceptions to the Right of Withdrawal
In accordance with Article L221-28 of the French Consumer Code, the right of withdrawal cannot, in particular, be exercised for:

products manufactured according to Customer specifications;
-
personalized products;
-
unsealed products that cannot be returned for reasons of protection, safety, traceability, or hygiene where the legal exception applies;
-
special orders;
-
products specifically procured for the Customer where their nature prevents normal resale;
-
products rendered unsuitable for resale due to opening, handling, installation, deterioration, or alteration.
Technical parts, watch crystals, movements, hands, dials, gaskets, crowns, and watchmaking components that have been opened, handled, or installed may be refused for return if they can no longer be resold as new.
ARTICLE 18 – Refunds
Where a consumer Customer validly exercises the right of withdrawal, TIMED S.A.S shall issue a refund in accordance with applicable French law.
The refund shall be made no later than fourteen (14) days from the date on which TIMED S.A.S is informed of the Customer's decision to withdraw.
TIMED S.A.S reserves the right to withhold reimbursement until the returned products have been received or until the Customer has provided proof of shipment.
The refund may be refused or reduced where the returned product shows depreciation resulting from excessive handling, installation, use, deterioration, or non-compliant return conditions.
Refunds shall be made using the same payment method used for the original purchase unless otherwise agreed.
ARTICLE 19 – Statutory Warranty
Products benefit from the statutory warranties provided under French law, including:

the statutory warranty of conformity;

the warranty against hidden defects.
The warranty does not cover:
-
normal wear and tear;
-
installation errors;
-
improper handling;
-
scratches;
-
impacts or shocks;
-
oxidation;
-
water ingress;
-
loss of water resistance;
-
unauthorized interventions or repairs;
-
damage caused by unsuitable tools;
-
damage caused to the watch or movement;
-
defects resulting from improper use.
TIMED S.A.S reserves the right to inspect or obtain an expert assessment of any product before approving a warranty claim.
ARTICLE 20 – Claims
Any claim must be submitted in writing to:

the order number;

clear photographs;
-
a detailed description of the issue;

the relevant product references;
-
any information useful for investigation.
No claim can be properly processed without sufficient supporting evidence.
ARTICLE 21 – Limitation of Liability
TIMED S.A.S shall not be held liable for:

watchmaker service fees;
-
installation costs;
-
disassembly costs;
-
diagnostic errors;
-
loss of business;
-
loss of revenue;
-
operational downtime;
-
indirect damages;
-
damage caused to a watch, movement, or third-party component;
-
consequences arising from installation performed by the Customer or by a third party.
In all circumstances, the liability of TIMED S.A.S shall be limited to the amount actually paid for the relevant order, except where otherwise required by mandatory law.
ARTICLE 22 – Professional Customers
Professional Customers do not benefit from any statutory right of withdrawal.
Any order placed by a professional Customer is firm, final, and non-cancellable.
Professional Customers acknowledge that they purchase technical products entirely at their own responsibility.
Returns from professional Customers shall only be accepted on a discretionary commercial basis and subject to prior written approval from TIMED S.A.S.
ARTICLE 23 – Force Majeure
TIMED S.A.S shall not be held liable for any failure or delay in performance resulting from an external, unforeseeable, and unavoidable event, including but not limited to:

strikes;

natural disasters;
-
pandemics;
-
transportation disruptions;
-
war;
-
cyberattacks;
-
supplier shortages;
-
scarcity of materials or products;
-
customs-related issues;
-
administrative decisions;
-
or any event preventing the normal execution of an order.
ARTICLE 24 – Personal Data
Personal data is processed in accordance with the General Data Protection Regulation (GDPR) and applicable French legislation.
Customers have, in particular, the rights of:

ARTICLE 25 – Intellectual Property
All content available on timed-horlogerie.com, including but not limited to texts, images, photographs, logos, product descriptions, graphics, videos, databases, and technical content, is protected by intellectual property laws.
Any reproduction, distribution, modification, or exploitation, whether in whole or in part, without the prior written authorization of TIMED S.A.S is strictly prohibited.
ARTICLE 26 – Consumer Mediation
In accordance with Articles L611-1 and following of the French Consumer Code, consumer Customers have the right to use a consumer mediation service free of charge for the amicable resolution of any dispute with TIMED S.A.S.
After first contacting TIMED S.A.S Customer Service in writing, the Customer may refer the matter to the competent consumer mediator whose contact details are available upon request or on the TIMED S.A.S website.
The European Commission also provides an Online Dispute Resolution (ODR) platform available at:

The use of mediation remains voluntary and does not affect the Customer's right to bring proceedings before the competent courts in accordance with applicable law.
ARTICLE 27 – Governing Law and Disputes
These Terms and Conditions of Sale shall be governed by French law.
In the event of a dispute, the parties shall first seek an amicable resolution.
Failing an amicable settlement, the dispute shall be submitted to the competent courts in accordance with applicable legal provisions.
ARTICLE 28 – Acceptance of the Terms and Conditions
By placing an order on the website, the Customer acknowledges having read, understood, and accepted these Terms and Conditions of Sale in their entirety without reservation.
