Article I. Scope and acceptance of the general terms and conditions of sale

These terms and conditions of sale govern the sale of all products, whether sold together or separately, and regardless of quantity. The customer declares having read and accepted the following provisions before placing their order.

APPLICABLE LAW / DISPUTES

All orders placed on the e-commerce website timed-horlogerie.com are addressed to TIMED, the official distributor of the TIMED brand. This implies unreserved acceptance of these terms and conditions of sale. It is the responsibility of each customer, whether professional or individual, to review TIMED's terms and conditions of sale before placing an order.

Orders placed by customers residing in metropolitan France, Corsica, and the French overseas departments and territories (DOM-TOM), as well as international sales, will be subject to French law. For all international sales, and for any matters not governed by French law and these general terms and conditions of sale, the parties agree to refer to the provisions of the Vienna Convention on Contracts for the International Sale of Goods of April 11, 1980.

The products offered for sale comply with French regulations. Where applicable, it is the responsibility of the foreign customer to check with local authorities regarding the permitted uses of the product they intend to order; TIMED cannot be held liable for non-compliance with the regulations of any foreign country where the product is delivered.

The parties will attempt to resolve amicably any disputes or disagreements relating to the formation or performance of the sale. Failing an agreement, the courts of TIMED's registered office shall have exclusive jurisdiction.

-These General Terms and Conditions of Sale (GTC) constitute the sole basis of the commercial relationship in accordance with Article L.441-1 of the French Commercial Code. They may not, under any circumstances, be invalidated or waived, even partially, by conflicting terms and conditions of the Customer, except with the express, prior, and written consent of TIMED SAS. These GTC take precedence over all other conflicting terms and conditions of the Customer, including those appearing on a document subsequently signed by an employee of TIMED SAS.


"Order placed via the Site" means any order placed online on the Site.

The term "professional" refers to any person who does not meet the definition of a consumer under French law and jurisprudence. These General Terms and Conditions of Sale are systematically provided to any Customer who requests them, to enable them to place an order with TIMED SAS.

By simply placing an order according to one of its two methods, the professional (hereinafter referred to as "the Client") declares and acknowledges having full knowledge of these general terms and conditions and accepts all of the clauses and conditions.

The Products whose sale is governed by these Terms and Conditions are those offered on the Site and only those (hereinafter referred to as "the Products").


TIMED SAS reserves the right to modify these terms and conditions at any time.

The applicable conditions are those in effect on the Site on the date the order is placed.

Validation of any order on the Site automatically implies acceptance and application of all of these Terms and Conditions, to the exclusion of all others, regardless of their terms and regardless of the document on which they appear.

The data recorded in the Seller's computer system constitutes proof of all transactions concluded with the Customer.

Article II. Product Characteristics

The characteristics of the products offered for sale are presented on the website https://masar-shop.com (hereinafter referred to as "the website"). Photographs are not contractually binding. TIMED cannot be held liable for any errors that may appear therein.

TIMED reserves the right to make any changes it deems necessary to its products at any time, and without obligation to modify previously delivered or ordered products, it reserves the right to modify the models in the site descriptions without prior notice.

Article II. Validity and duration of products (offers)

Products, including those with special offers, are available for sale while supplies last. We take special care to remove any product from our website as soon as it is out of stock. If an order is not available, the customer will be notified as soon as possible by email or telephone. Sales generated by a promotion that should not have applied due to a technical issue cannot be honored if the exclusion of the promotion from a product, product range, or minimum/maximum price was clearly stated.

Article IV. The price of the products

The prices of products on the website are in Euros, inclusive of all taxes and excluding any delivery charges. Any delivery charges are the responsibility of the customer and are billed in addition to the product price and any applicable service charges. Delivery charges vary depending on the number and type of products ordered. The customer will always be informed of the delivery charges associated with their order before final confirmation, and payment will be requested for the total purchase amount. Therefore, by selecting and confirming a payment method, the customer agrees to pay the corresponding delivery charges. Delivery charges cannot be considered a valid reason for canceling an order after it has been finalized.

Article V. Order Confirmation

The customer confirms their order by clicking the "CONFIRM" link on the "Secure Payment by Credit Card or other" page. By doing so, they implicitly accept the order process and these terms and conditions of sale.

TIMED SAS confirms the order by email; this confirmation includes all order details. The data recorded by TIMED SAS constitutes proof of the nature, content, and date of the order.

Article VI. Payment.

Payment can only be made by credit card, PayPal, Amazon Pay, or Google Pay. The online payment section of the website https://timed-horlogerie.com/ uses a secure payment system, Shopify Payments, with SSL encryption of all information. Under no circumstances is this information managed or stored on our servers or the https://timed-horlogerie.com/ website.

1- Payment methods

Please note that the Customer can pay for their order:

  • either online by bank card (Visa, Eurocard Mastercard),
  • either by bank transfer,
  • either via Paypal,
  • either by check made payable to "Société TIMED SAS".

2- Cancellation due to non-payment.

In the case of payment by check, the check will be cashed upon receipt. It must reach us within three weeks of the order. After three weeks, the order will be automatically canceled.

If the bank declines a credit card payment or refuses to cash a check, the Customer must contact customer service to arrange payment by another method. Otherwise, TIMED SAS reserves the right to cancel the order.

Customer credit card information for timed-horlogerie.com is not saved by TIMED SAS.


Article VII. Delivery.


Orders are processed on business days (Monday to Friday). Shipments are handled by La Poste or Colissimo (La Poste's services), as well as Amazon and UPS for mainland France, overseas territories, and international destinations.

Delivery delays cannot under any circumstances give rise to damages, withholding of payment or cancellation of pending orders.

The risks associated with transport are borne by the buyer who, in the event of damage and/or missing items noted upon receipt, must make all the usual reservations with the carrier and inform TIMED's Customer Service within 24 hours by:

Shipping via CHRONOPOST

Speed: Once your package is picked up by La Poste, you will receive home delivery within 24 hours in mainland France and Monaco. Pickup/Delivery: Upon delivery, any damage or loss must be noted by the recipient in writing, with specific, complete, dated, and signed reservations on the delivery slip.

Loss/Damage: CHRONOPOST is liable for any loss or damage to the package during transport or for non-delivery, except in cases of fault by the sender or recipient, force majeure, inherent defect of the item, or insufficient packaging, which are not exhaustive examples of exemptions. Delays: For domestic shipments, delivery times are calculated from Monday to Saturday morning for collection and from Monday to Friday for delivery, excluding public holidays. Depending on the service, Saturday delivery may be available as an option. For international shipments, delivery times are calculated from Monday to Friday for collection, except for shipments handed over on Saturday, for which the delivery time begins the following Monday. Deliveries are made on business days, excluding public holidays, in the destination country.

Shipments via Colissimo

Speed: From the moment it is picked up by La Poste, you will receive your delivery at home within 48 hours (working days for shipments in mainland France, Corsica and Monaco).

Security: With Colissimo, your order is delivered Monday through Saturday between 9 a.m. and 2 p.m., directly to you and requiring a signature. If you are absent or unable to receive your package (no concierge, etc.), your postal carrier will leave a delivery notice indicating the date and address of the post office where you can collect your package upon presentation of identification. From the date indicated on the delivery notice, you have 15 days to collect your package. After this period, it will be automatically returned to the sender.

FORCE MAJEURE, BY ORDER OF THE PRINCE

TIMED shall not be held liable for any failure to fulfill its contractual obligations in the event of force majeure or government action. In such cases, TIMED is under no obligation to inform the customer of this inability. Furthermore, the customer may not cancel their order or initiate any compensation proceedings against TIMED.

 Article VIII. Guarantees.

TIMED disclaims all liability in the event of misuse of its products. The following list of cases in which the warranty does not apply is not exhaustive:

- in case of damage resulting from accidents

- in the event of interventions outside of TIMED's services

- in case of rust being present in the movement of non-waterproof watches

Return shipping costs related to the application of the commercial warranty are the responsibility of the sender, unlike shipping costs after repair, which are covered by TIMED. The TIMED after-sales service, accessible through the website timed-horlogerie.com, is the only authorized service provider for repairing equipment and products under warranty. Defective products covered by this warranty should be shipped to TIMED - TIMED Horlogerie Service, 23 avenue de l'Europe, 33520 Bruges, Nouvelle-Aquitaine, France.

 Article IX. Order Cancellation.

Individual customers only have 14 (fourteen) calendar days from the date of delivery to return the product, with return shipping costs borne by the customer. They will then be refunded the price of the product within a maximum of fourteen days from the date the product is returned to TIMED's premises.

However, products returned incomplete, damaged or defective due to improper handling will not be accepted for return or exchange.

All personal data (name, address, telephone numbers, fax or email address, IP address of your computer...) that you have provided to us through the website https://masar-shop.fr/ will not be disclosed to third parties.

This information will not be used without your consent; we will only use it to send you emails or letters.

In accordance with Article 34 of the French Data Protection Act (Loi Informatique et Libertés), you have the right to access, rectify, and delete your personal data. To exercise this right, please contact TIMED France, web service.

Article XI. Claims

1- Missing and damaged transport

Upon delivery, the Customer must check the goods in the presence of the carrier.

In the event of missing or damaged goods during transport, it is the Client's responsibility, as the recipient, to make specific reservations on the carrier's delivery receipt and to confirm them to the carrier, in accordance with the provisions of Article L 133-3 of the French Commercial Code, by registered letter with acknowledgment of receipt within three days of receipt, with a copy to TIMED.SAS.

Otherwise, the customer will no longer be able to pursue any claim based on missing or damaged goods, either against the carrier or against TIMED SAS.


2- Delay due to the carrier

In the event of a delay compared to the appointment date announced by the carriers, the Client must contact the carrier first.

In the event of a significant delay, the Customer must contact TIMED SAS to open a dispute or investigation file to search for the package.


3- Delays beyond the control of TIMED SAS and the carrier

In the event of force majeure which has the effect of slowing down or preventing delivery in particular in the event of a strike of the services of La Poste, strike of carriers, heavy road traffic or any other event of an exceptional nature slowing down or preventing the delivery of parcels, the company TIMED SAS will make its best efforts to inform the customer of the status of the shipment of his parcel, but cannot be held responsible for the delays caused.

Force majeure is understood as defined by case law and in particular in the event of disruption, flood, fire, total or partial strike (in particular of postal services, means of transport, means of communication), interruption of supplies and energy and transport supplies, general administrative decisions, epidemic, pandemic, or any other cause beyond TIMED SAS's control. In all cases, the Customer may request the cancellation of the sale in the event of a definitive impediment to delivery.


Article XII. Legal Guarantee


In accordance with the provisions of Articles L. 211-1 et seq. of the Consumer Code, the Customer is informed that the Products supplied by TIMED SAS benefit by right and without additional payment, in accordance with legal provisions, from the legal guarantee of conformity, and from the legal guarantee against hidden defects arising from a defect in material, design or manufacture affecting the delivered products and rendering them unfit for use, under the conditions and according to the terms referred to in the box below and recalled in the appendix to these General Terms and Conditions of Sale (Guarantee of Conformity / Guarantee against Hidden Defects).


Reminder of the legal provisions.

When acting on the basis of the legal guarantee of conformity under Articles L.217-4 to L.217-13 of the Consumer Code, the Customer:


- benefits from a period of two years from the delivery of the goods to take action;

- may choose between repair or replacement of the goods, subject to the cost conditions provided for in Article L. 217-9 et seq. of the Consumer Code;

- is exempt from providing proof of the existence of the non-conformity of the goods within twenty-four months from the delivery of the goods.

The legal guarantee of conformity, in respect of which the seller cannot be exempted or limit its scope, applies independently of any commercial guarantee.


If the Customer brings an action based on the warranty against hidden defects in the goods sold, within two years of discovering the hidden defect, under the conditions set forth in Articles 1641 to 1649 of the French Civil Code, the Customer may request either the cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Code. For your complete information, the articles of the French Civil Code relating to warranties are attached to these General Terms and Conditions of Sale. (Appendix 1)


In the event of non-conformity of the delivered Product, the Customer may choose between returning the Product and being reimbursed for the price and related costs or keeping the product and being reimbursed for part of the price, subject to the cost conditions provided for in Article L.217-9 of the Consumer Code.

The Customer may return the goods and receive a full refund or keep the goods and receive a partial refund, in the three cases outlined in Article L 217-10 of the French Consumer Code: (i) if replacement is impossible, (ii) if the requested remedy cannot be implemented within one month of the Customer's complaint, and (iii) if remedying the defect cannot be achieved without significant inconvenience to the Customer, taking into account the nature of the goods and their intended use. However, the contract cannot be terminated for a minor lack of conformity.


Shipping costs will be refunded based on the invoiced rate and return costs will be refunded upon presentation of proof of payment.

Subject to compliance with the conditions mentioned above, TIMED SAS will reimburse the costs of delivery and return, using the means of payment used to pay for the order, as soon as possible and at the latest within thirty (30) days following the finding by TIMED SAS of the non-conformity or hidden defect.

Products modified, integrated or added by the Customer or any other person not authorized by TIMED SAS are excluded from the warranty. The warranty will not cover apparent defects.



Article XIII. Limitation - Exemption from liability


Case of exclusion of liability of the Company TIMED SAS

TIMED SAS declines all responsibility for the misuse or improper use of the Products ordered by the Customer.


TIMED SAS is not responsible in any way for the consequences resulting from: the storage of products under abnormal conditions or conditions incompatible with their nature, their transformation, failure to comply with normal use, assembly and subsequent disassembly of the products, the loss or breakage of any part, in particular during unpacking and assembly, abnormal wear resulting from poor maintenance, poor protection during handling, swelling of the products due to water infiltration, shocks or inappropriate use, temperatures or humidity levels.

Claims must be notified before the product is installed or implemented. Any claim based on non-conformity of the delivered Products or an apparent defect must be notified before the Product is installed (or implemented: transformation, modification, etc.) by registered letter to the registered office of TIMED SAS.

To facilitate a swift resolution of the claim, the Customer will provide TIMED SAS with all necessary evidence to verify the reported non-conformity. Specifically, the Customer will provide one or more photographs enabling TIMED SAS to assess the situation (e.g., a photo with a tape measure, calipers, a ruler, etc.). All non-conformities will be subject to review by TIMED SAS.

Otherwise, the Products will be deemed to have been accepted and acknowledged as compliant. Therefore, since the alleged defects are known or cannot be ignored by the Customer, no further recourse will be available against TIMED SAS.


In any case, the costs of removal and reinstallation are never reimbursed.


Article XIV. Other Websites


Apart from the website http://www.timed-horlogerie.com, websites linked directly or indirectly to http://www.timed-horlogerie.com are not under the control of TIMED SAS. Links to third-party websites are provided for convenience only and do not imply any guarantee as to their content. Consequently, TIMED SAS assumes no responsibility for the information published on these websites.


Article XV. Information Technology and Freedoms - Personal Data


TIMED SAS collects and processes personal data in accordance with the regulations in force on the protection of personal data, applicable in Europe and in France and in particular the provisions of the General Data Protection Regulation of 27 April 2016 (European Regulation known as "GDPR").

TIMED SAS collects personal data in the context of fulfilling its contractual and legal obligations or pursuing its legitimate interests.


When a customer registers or places an order, or as part of other specific operations, TIMED SAS offers visitors or customers the option to receive its newsletter, promotional offers, and/or to register to be informed of its "event sales". The visitor or customer can modify their subscription at any time through their personal account, or via the hyperlink at the bottom of the emails they receive.

This data is kept for the entire duration of the business relationship, and for as long as necessary to fulfill the contractual obligations of TIMED SAS, to comply with its legal obligations, and to satisfy the purposes described in its privacy policy.

- the price of the Products and additional costs (delivery, for example);

- in the absence of immediate execution of the contract, the date or period within which the Seller undertakes to deliver the Product;

- information relating to legal guarantees and how to implement them;
